NOTICE OF CONSULTATION

SECTION 106 OF THE NATIONAL HISTORIC PRESERVATION ACT OF 1966 AS AMENDED (2006)

PROGRAMMATIC AGREEMENT

AMONG

THE FEDERAL HIGHWAY ADMINISTRATION, THE HAWAIʻI STATE HISTORICAL PRESERVATION OFFICER, THE ADVISORY COUNCIL ON HISTORIC PRESERVATION, AND THE HAWAIʻI STATE DEPARTMENT OF TRANSPORTATION REGARDING UNDERTAKINGS AFFECTING THE FORMER OʻAHU RAILROAD & LAND COMPANY (OR&L) RIGHT-OF-WAY (ROW)

 

Notice is hereby given that the Federal Highway Administration (FHWA) and the State of Hawaiʻi Department of Transportation (HDOT) are continuing with the development of a Programmatic Agreement under the National Historic Preservation Act, Section 106 process for future requests relating to the former Oʻahu Railroad & Land Company (OR&L) Right-of-Way (ROW). Examples of the requests that would be covered under the Programmatic Agreement are: use and occupancy licenses, permits or easements, and federally funded projects involving the former OR&L ROW. Interested parties are invited to review this draft of the documents included below:
